    This paper presents the formulation, validation and application of the fictitious domain least squares spectral element approach for steady Navier-Stokes equation. This formulation is of particular interest to study problems in a domain which changes in time and space, as fictitious domain approach allows to avoid the remeshing of computational domain in the presence of geometric variations. The excellent convergence of the least squares functional and error bounds are verified using the Wannier flow solution to the incompressible Stokes equations and the Kovasznay flow solution to the incompressible Navier-Stokes equations. Numerical results for steady flow past circular cylinder and incompressible flow over a backward-facing step are presented and found to be in total agreement with benchmark solutions.
