This paper examines many of the theoretical foundations and limitations of an earlier proposed method for solving nonlinear differential algebraic equations (DAE) of higher index. The method uses nonlinear singular least squares methods for solving the derivative array equations of the nonlinear DAE and is described by \textit{S. L. Campbell} [Numerical and applied mathematics, Part II (Paris 1988), 555-560, IMACS Ann. Comput. Appl. Math., 1.2, Baltzer, Basel (1989)]. The results are intended general rather than aimed at the specific structures of various applications.
