    The paper deals with the nonsmooth critical point theory. The authors study the existence of multiple critical points of functionals being the sums of locally Lipschitzian and convex lower semicontinuous functions subject to a suitable assumption of the Palais-Smale type and under the presence of the local linking geometry of the functional (the assumption is slightly stronger than the classical one due to Liu and Li and Brezis and Nirenberg in the smooth case and that of Kandilakis et al. in the locally Lipschitzian case). The result is established in a series of lemmas and propositions. Next, the abstract result is applied to obtain a solution to an eigenvalue problem for an elliptic variational-hemivariational inequality.
