In this paper the author proposes a correction of the original variational principle of \textit{J. W. Herivel} [Proc. Camb. Philos. Soc. 51, 344-349 (1955; Zbl 0068.188)] taking into account the constraint expressing the conservation of the identity of the particle. The thermodynamic considerations are left out and only simplest boundary conditions are considered. The theory is applied to some classical problems: perfect (incompressible and compressible) fluids, general hyperelastic body, fluid with non-diffusing bubbles.
