    The author gives examples of rank zero elliptic curves over \(\mathbb Q\) for which a positive proportion of the quadratic twists satisfy the Birch and Swinnerton-Dyer conjecture modulo 3 (Proposition 2.2). The main example is \(E: y^2= x^3+ x^2+ 72x-368\) (Theorem 1.2). Main ingredients in the proof are: a theorem of \textit{G. Frey} [Can. J. Math. 40, No. 3, 649--665 (1988; Zbl 0646.14024)] and the results of the author [J. Am. Math. Soc. 11, 635--641 (1998; Zbl 0904.11015)].
