The influence of the lateral variation of the surface tension on a ferrofluid layer subjected to constant magnetic field and normal gradient of temperature is considered. The layer is resting on a solid support or hanging from it. The direction of the magnetic field is parallel or antiparallel to the gravity. The mathematical description of the problem consists of a set of Maxwell equations, Navier-Stokes equations with a forcing term coming from the magnetic field, energy balance of the fluid in motion and a detailed description of the free surface behavior. The latter accounts for interrelation between the temperature dependent surface tension, stress tensor including magnetic field contributions and Newton's law of cooling. The stability of the set is studied using Fourier expansion of the perturbed quantities.
