    The aim of this paper is to analyse the mathematical model for the thermo-mechanical behaviour of metallic alloys having the shape memory effects. The applied model does not follow the classical Fourier-theory, Catteneo-Maxwell law is used. The mechanical and thermodynamic constitutive equations of the model along with the initial and boundary value problem are presented. Existence and uniqueness of the solutions to the formulated initial-boundary value problem are derived by a variational formulation. Lipschitz continuous dependence of the solution on the data with respect to some norms is given. Uniqueness of the solution is also performed by a fixed point argument. In the appendix, some existence, uniqueness and regularity results for a class of parabolic variational inequalities that are involved in the system of PDEs analysed above are proven.
