    The authors analyze the existence of solutions of the nonlinear complementarity problem, using the concept of exceptional family of elements for set-valued mappings in the sense introduced in [\textit{G. Isac}, ``Topological methods in complementarity theory'' (Nonconvex Optimization and Its Applications 41; Dordrecht:\ Kluwer Academic Publishers) (2000; Zbl 0954.90056)]. The authors prove that, under certain assumptions on the set-valued mapping \(F\), either the corresponding nonlinear complementarity problem has a solution, or a certain exceptional family of elements exists for \(F\). The proof of this result uses topological degree theory for set-valued mappings, instead of the Leray--Schauder type alternative and the technique of continuous selections.
