    Let \((X,\| \|)\) be a Banach space. Let C be a closed convex set in X. We say that the set C has drop property, if for any closed set A there is \(a\in A\) such that \(conv(\{a\}\cup C)\cap A=\{a\}.\) In the paper it was shown that if C has drop property, then either C is compact or it has non-empty interior. If C has non-empty interior, then C has drop property if and only if for each continuous linear functional f such that \(M=\sup_{x\in C}f(x)<+\infty,\) the set \(S(f,C,\delta)=\{x\in C:\quad f(x)\geq M-\delta \}\) has the index of non-compactness tending to 0, when \(\delta\) \(\to 0\). In the paper several properties of sets with drop property are given.
