    The title of the paper says it all. The Berger theorem [Proc. Lond. Math. Soc., III. Ser. 42, 59-86 (1981; Zbl 0456.20006)] deals successfully with the problem of deciding whether or not a group belongs to the lower star of a given Fitting class that is reasonably well-behaved. In proving his theorem, \textit{T. R. Berger} employed the transfer normal Fitting pairs introduced by \textit{H. Laue, H. Lausch} and \textit{G. R. Pain} [Math. Z. 154, 257-260 (1977; Zbl 0337.20013)], which \textit{T. R. Berger} [Math. Z. 151, 1-3 (1976; Zbl 0319.20023)] himself had prompted. For arbitrary Fitting classes, no decision method is known. The author highlights the difficulty of the problem by constructing a Fitting class, \(\mathcal D\), such that the transfer normal Fitting pairs, used in the proof of the Berger Theorem, are not sufficient to determine \({\mathcal D}_ *\) (Theorem 40). The construction techniques, of interest in themselves, are somewhat similar to \textit{R. S. Dark}'s [Math. Z. 127, 145-156 (1972; Zbl 0226.20013)].
