    For a bounded nonempty set \(F\) in a Banach space \(X\), it is denoted by \(\chi(F)\) the number \(\sup_{x\in F}(\inf_{y\in F^c}\| x-y\| / \sup_{y\in F}\| x-y\|), \) where \(F^c \) is the complement of \(F\). Let \(F_1\supseteq \ldots\supseteq F_n\supseteq\ldots\) be a sequence of embedded bounded closed sets. \textit{N. N. Vakhaniya} and \textit{I. N. Kartsivadze} [Mat. Zametki 3, 165-170 (1968; Zbl 0162.44302)] have proved that if \(\chi=\limsup \chi(F_n)>1/2\) then \(\cap_{n\geq 1}F_n\neq \emptyset\), and the constant 1/2 cannot be improved. The present author shows that if \(X\) is a dual Banach space and \( \chi=1/2, \) then the intersection of the sets \(F_n\) is again nonempty. For \( \chi < 1/2 \) and a convenient \( p=p(\chi) >1 \) he constructs in \(\ell_p \) a sequence of bounded closed sets \( F_1\supseteq \ldots\supseteq F_n\supseteq\ldots \) with \(\cap_{n\geq 1}F_n=\emptyset. \).
