Summary: We give a new and correct proof of a result of \textit{O. Ferri} and \textit{S. Ferri} [Ratio Math. 9, 69--72 (1995)] on \(q^2\)-caps of \(\mathrm{AG}(3, q)\) in this paper; moreover, we prove that sets of \(\mathrm{AG}(3, q)\) of type \((1,q,q+1)\) with respect to the planes of \(\mathrm{AG}(3, q)\) have size at most \(q^2\) with equality if and only if \(\mathcal K\) is a cap.
