    The authors consider the functional differential inclusion \((*)\) \(\dot x(t)\in L(t,x_ t)+F(t,x_ t)\), a.e. on \([0,b]\), \(x(t)=\phi(t)\) on \(t\in [-r,0]\), where \(L\) is continuous and linear, \(F\) is upper semicontinuous in \(x_ t\) and with bounded compact convex values in \(\mathbb{R}^ n\). Via Kakutani fixed point theorem it is proved that \((*)\) has a solution.
