    Let \(X\) be a separable Banach space; \({\mathcal K}\subset X\) be a cone and \(v: [-\tau,a]\to X\) be a solution of a problem \(\dot v(t)\in F(t,v_ t)+{\mathcal K}\), \(t\in [0,a]\); \(v_ 0\geq\varphi\), where \(F\) is a Carathéodory type multifunction with convex closed values satisfying the Ambrosetti type regularity condition. The viability result is applied to prove the existence of the solution \(u(\cdot)\) of a functional- differential inclusion (1) \(\dot u(t)\in F(t,u_ t)\), \(u_ 0=\varphi\) such that \(u\leq v\). For the case \(X=\mathbb{R}^ n\), \({\mathcal K}=\mathbb{R}^ n_ +\) the existence of a minimal solution of (1) is obtained as a corollary.
