      The fictitious domain method, which can be successfully used for time-dependent moving-boundary problems, consists in solving the boundary value problem in a larger fictitios domain, with a simple shape, containing the domain of interest. A penalty parameter is used to reformulate the problem in the fictitious domain, avoiding the time-consuming construction of boundary-fitted meshes. The authors study the \( H^{1}\)-penalty problems and obtain some results (which are not currently found in the literature) concerning the error estimates between the solutions of \(H^{1}\)-penalty problems and discrete problems in \(H^{1}\) and \(L^{2}\) norms. An approximation scheme for the discrete problem and error estimates is derived.
