    For a complex smooth projective curve \(C\) of genus \(g\), the coarse moduli space \(M_r\) of semistable rank-\(r\) vector bundles with trivial determinant, is considered. The author investigates whether the set of bundles \(E \in M_r\) without theta divisor is nonempty. Let \(r(C)\) be a minimal rank of vector bundle with trivial determinant over \(C\) without theta divisor. The author improves the estimate given in \textit{D. Arcara} [C. R. Acad. Sci. Paris Math. 340, No. 2, 131--134 (2005; Zbl 1062.14041)]. The general curve \(C\) as well as the hyperelliptic \(C\) are considered. Relevant papers: \textit{A. Beauville} [Am. J.
