In this paper, a new variable \(\epsilon\) penalty method is proposed for the Stokes problem. The stability is proved and an approximation error is derived for the Stokes problem with the new pointwise penalty. The algorithm is tested on the Stokes problem and on the incompressible Navier Stokes problem using elementwise penalty. Tests indicate that the new adaptive-\(\epsilon\) penalty method algorithm predicts flow behavior accurately.
