The paper deals with the investigation of the Cauchy problem for the Boltzmann equation for rarefied gases. The problem is treated near Maxwellian equilibrium and the kernel of the collisional operator is taken without angular cut-off. The existence and uniqueness is established in a critical Chemin-Lerner space. In the proof, the authors combine two previous ideas. The first idea has been used by Duan, Liu and Xu to prove the existence of strong solutions under the assumption of Grad's angular cut-off. The second one, introduced by Alexandre, Morimoto, Ukai, Xu, and Yang, consists of using a Chemin-Lerner type triple norm for treating for treating the collisional term.
