The main goal of this paper is to identify all piecewise polynomial finite element spaces, which are weakly non-conforming and to develop a general method for the derivation of intrinsic conforming and non-conforming finite elements from theoretical principles for the discretization of elliptic partial differential equations. The approach proposed here for Poisson's equation, as a model problem, enables the authors to recover non-conforming elements like the Crouzeix-Raviart element [\textit{M. Crouzeix} and \textit{P.-A. Raviart}, Rev. Franc. Automat. Inform. Rech. Operat. 7(1973), R-3, 33--76 (1974; Zbl 0302.65087)], and a few others including the standard conforming \(hp\)-finite elements. By using a similar argument, it is observed that it can be shown that intrinsic derivation of non-conforming finite elements presented here allows one to recover the second-order non-conforming Fortin-Soulie element [\textit{M. Fortin} and \textit{M. Soulie}, Int. J. Numer. Methods Eng. 19, 505--520 (1983; Zbl 0514.73068)], and the third-order Crouzeix-Falk element [\textit{M. Crouzeix} and \textit{R. S. Falk}, Math. Comput. 52, No. 186, 437--456 (1989; Zbl 0685.76018)].
