In this paper the author gives a characterization of the planes meeting the non-singular quadric of \(\mathrm{PG}(4,q)\) in a conic and gives the following essential results where \(S\) is a set of planes in \(\mathrm{PG}(4,q)\): (1) Every point lies on \(q^{4}\) or \(q^{4}+q^{2}\) planes in \(S\). (2) Every line lies on \(0\) or \(q^{2}\) planes of \(S\). (3) Every 3-space contains at least one plane of \(S\). Using these results, the author gives an alternative proof of de Remini's characterization theorem.
