    In this paper a result about constrained Willmore tori in \(S^3\) is proved. Constrained Willmore surfaces are critical points of the Willmore functional under conformal variations. In particular, contrained Willmore tori are the tori with constant mean curvature (CMC) in a 3-dimensional space form. To any conformally immersed constrained Willmore torus \(f\), one can associate a compact Riemann surface \(\Sigma\), called the spectral curve, such that \(f\) can be reconstructed in terms of algebraic data on \(\Sigma\). The main result of the paper states that, under a mild assumption of simplicity for the torus, a simple constrained Willmore torus in \(S^3\) is a CMC torus if and only if its spectral curve has the structure of a CMC spectral curve.
