A lattice \(L\), which is a free \(\mathbb Z\)-module, is even if the given positive definite symmetric bilinear form, denoted by \(x \cdot y\), has \(x \cdot x \in 2\mathbb Z\), for all \(x \in L\). An even lattice which is equal to its dual lattice, with respect to this form, is said to be a Type II lattice. If the minimum norm of the Type II lattice is \(2(1 + \lfloor \frac{n}{24} \rfloor)\), then the lattice is extremal. The author constructs a \(40\)-dimensional extremal Type~II lattice, not having any subsets consisting of \(40\) orthogonal minimal vectors, which is distinct from the numerous lattices constructed from binary self-dual codes by the classical construction. The author also determines the automorphism group of this lattice.
