Let \(K\) be a \(k\)-set in \(\mathrm{PG}(n,Q)\) and let \(a_i\) be the number of \(d\)-dimensional subspaces meeting \(K\) in \(m_i\) points. \(K\) is a \(k-(m_1, m_2, \dots m_h)_d\) set if there are exactly \(h\) different intersection numbers for which \(a_i>0\). \(K\) is also called an \(h\) character \(k\)-set with respect to dimension \(d\). If \(h=2\) and \(d=n-1\), then \(K\) is a two character \(k\)-set. Hermitian varieties in \(\mathrm{PG}(n,Q)\) exist if \(Q=q^2\), and finding simple combinatorial properties which characterize them is of particular interest. In the present paper, the authors prove that if \(q>2\), \(q=p^h\), \(p\) prime and \(K\) is a two character \((q^7+q^5+q^2+1)_3\)-set in \(\mathrm{PG}(4,q^2)\) and a three character \((q^7+q^5+q^2+1)_2\)-set with minimum intersection number \(q^2+1\), then \(K\) is a Hermitian hypersurface.
