    A set of type \((q+1,n)\) in \(\mathrm{PG}(3,q)\) is a subset of points such that each plane intersects the set in either \(q+1\) or \(n\) points. The authors prove the following. Let \(K\) be a set of type \((q+1,n)\) with \(n>q+1\). If \(K\) is not a plane and contains at least one line then \(n=2q+1\). If \(K\) is not a plane and does not contain a line, then \(n=2q+1\) if \(q\) is a prime or if \(q \leq 271441\) with \(q=p^h\), \(p\) prime and \(h>1\).
