      The author introduces the operad \(Ger^+_{\infty}\) and compares it to well-known operads. The main idea is that this new operad provides a 2-colored version of the homotopy Gerstenhaber operad, so that algebras over it consist of pairs \((V,A)\), where \(V\) is a homotopy Gerstenhaber algebra and \(A\) is an \(A_\infty\)-algebra, together with an \(L_\infty\)-map from \(V\) to the Hochschild cochain complex on \(A\). Furthermore, this operad can be regarded as an extension of the operad whose algebras are open-closed homotopy algebras. It is also a suboperad of the first page of the homology spectral sequence of the Swiss cheese operad. It is proved that the operad \(Ger^+_\infty\) is not formal; the proof also carries over to show that the first page of the spectral sequence for the Swiss cheese operad is also not formal.
