The authors prove the following theorem together with several generalizations: Let M be a surface in \(E^ 3\). Suppose that, through each \(p\in M\), there exist two circles of \(E^ 3\) which are tangent to each other at p, and contained in M near p. Then M is locally a plane or a sphere.
