For a finite group \(G\) let \(H(G)\) denote the intersection of the maximal non-nilpotent subgroups of \(G\). For soluble \(G\), and for nilpotent \(H(G)\) such that \(\Phi(G)<H(G)<G\), the authors are able to describe in detail the structure of \(G/\Phi(G)\) (Theorem 2.1). Theorem 2.3 asserts that for \(G\) soluble and nonnilpotent and with \(1=\Phi(G)<H(G)\) where \(H(G)\) is nilpotent one must have \(F(G)=G'\times Z(G)\). The last section deals with an analogue of \(H(G)\) defined for saturated formations containing the nilpotent groups.
